GAMING PLAN

 1. INTRODUCTORY PROVISIONS

 FORTUNA sázková kancelář a.s. („Fortuna Betting Shop, Ltd.“) (hereinafter referred to as „Fortuna“) organizes odds beting in accordance with the provisions of the Lottery and Other Similar Games Act No. 292/1990 Coll., as amended., FORTUNA sázková kancelář a.s. with its registered at Vodičkova 30, 110 00 Praha 1, IČ_{[Incorporation No.]:} 00418382  DIČ _{[Tax Registration No.]}: CZ00418382 was recorded in the Commercial Register section B inset 60 conducted by the Municipal Court in Prague on 29 March 1990. All the bets are accepted  in the Czech Republic based on the licence issued by the Ministry of Finance of the Czech Republic. Betting may be only participated in by persons more than 18 years old.  This Gaming Plan (hereinafter referred to as „HP“) is binding for the legal relationship established  by and between the bettor and Fortuna.  Lack of knowledge of HP provisions or their subjective interpretation does not cause the wager to be invalid and when settling possible disputes resulting from bets, the circumstance that the bettor does not know HP provisions shall not be considered.

2. BASIC TERMINOLOGY

2.1 Odds betting

Odds betting means the game participated in by a natural person by means of payment of the amount bet the return of which is not guaranteed. The winnings or the loss is decided by chance or the circumstance not known in advance or the event mentioned by the operator  in the gaming terms and conditions.  Odds betting the rules of which are the subject matter of these HP are operated in accordance with the Lottery and Other Similar Games Act No. 202/1990 Coll., as amended.

2.2 Bet amount

The bet amount is a financial sum to be paid by the bettor not later than at the instant of laying the bet in cash, by bank transfer or credit card.

2.3 Betting opportunity (“SP”)

The betting opportunity is a sports or another event, selected by Fortuna and published at the branch offices and by other Fortuna  information channels. Bets are accepted for sporting events and competitions (and events connected therewith), as well as other events provoking public interest and not contradicting ethical principles. Betting opportunity includes the tips representing possible results.

 2.4 Tip

As regards matches, symbols 1, 2, 0,10, 02, 12 are used to indicate the basic tips.»1« means the tip of a racer (or a team etc.) referred to in the name of the betting opportunity as the first one in the sequence.

»2« means  the tip of a racer (or a team etc.) referred to as the second  in the sequence.»0« means the tip of a draw. Double tip »10« means a bet on the victory of the team referred to as the first one in the sequence or a bet on the draw. Double tip »02« means a bet on the victory of the team referred to as the second one in the sequence or a bet on the draw. Double tip »12« means a bet on that the match will not end by the draw. Symbols »1:0«, »3:2« and others represent a tip of the exact result of the match in question. As regards races and competitions, the following symbols are used to indicate a tip:V (victory); 1-2 (positioning on the first or second place); 1-4 (positioning up to the fourth place), 1-8 etc.

2.5 Odds

Odds express the probability of the tip to be brought about. Odds applicable at the time of laying the bet are binding for both the parties regardless of any later modifications thereof.

 2.6 Winnings

The winnings are subject to the correct specifications of the SP results unknown in advance.  The value of the winnings is equal to the product of the odds and the sum bet.  Winnings shall be rounded off to whole Czech crowns upon payment.

2.7 Possible winning quota (hereinafter referred to as “EVK”)

EVK represents the winnings won by the bettor in the event that  the bettor´s tips of all the betting opportunities have been brought about and the bettor has correctly estimated all the results.

 2.8 Types of betting opportunities

2.8.1 SP with  two possible results E.g. a tennis match, advancement in a competion, bets  »who guesses better«.

2.8.2 SP with three possible results E.g. football and hockey matches.

2.8.3 Bets on the victory or positioning of individuals (or teams etc.) in a competion being of both the long- and short-term nature.

2.8.4 Bets type »Pole« (in English “Field”)These bets may be laid on the victory or the positioning .Bet on the »Pole« (“Field”) is a bet on the group of individuals, and/or teams. This group may be formed according to Foruna specification both by the specifically mentioned individuals (teams) or all not mentioned by name  within the specification of the betting opportunities in particular.

2.8.5 Bets directly connected with the results of sporting or other events E.g. a bet on the exact result of a selected match, team victory by a certain goal difference,  scorer,  number of goals in a competition or a match, result of a partial portion of the match 

2.8.6 Numerical games

The numerical games are a specific type of the odds betting, when a certain quantity of the winning numbers is drawn from the wheel of fortune with the attendance of the public, three Fortuna representatives and a person discharging state supervision. The subject matter of betting is to determine, whether the guessed number/s will be among the number drawn for a certain type of the game. To cast lots, only the quantity of numbers specified in advance, which have been drawn as the first ones in a sequence, shall be valid. If, for instance, one or more numbers have been drawn due to a failure of the equipment or the person operating the equipment, they shall not be considered.

2.8.6.1 Types of numerical games

„3 of 21“ – means that three numbers of a total of 21 are drawn. Possible tips are the bets on one, two or three numbers.

„9 of  49“ - means that nine numbers of a total of 49 are drawn.  Possible tips are the bets on one to six numbers. 

„5 of  50“ - means that five numbers of a total of 50 are drawn.   Possible tips are the bets on one to five numbers. 

„20 of 80“ - means that twenty numbers of a total of 80 are drawn. Possible tips are the bets on one to eight numbers. 

 

2.9 Bets laid in the course of a betting opportunity under procedure (bets  type LIVE)

Fortuna can accept bets for certain specified and specifically marked betting opportunities (“LIVE”) also in the course of the race or match in question. Odds of individual tips are adjusted on a continuous basis and are valid at all times at the instant of laying the bet.  

Bets type LIVE are accepted only at the branch offices allowed for this type of bets.

A bet type LIVE which has been already laid cannot be cancelled any more and the bettor is obliged to approve its accuracy with the person accepting the bet still prior to issuance of the ticket.

 2.10 Ticket

The ticket is a confirmation of the laid bet. The ticket mentions all the relevant data. Some of them may be indicated by a code or an abbreviation.  Falsifying or changing the tickets without authorization results in termination of the claim to the winnings  and shall be prosecuted in accordance with the applicable legal regulations of the Czech Republic.

  

3. TYPES OF BETS

 3.1 Single bets (“SOLO”)

SOLO is the bet on  a single betting opportunity.

 3.2 Accumulated bets

Accumulated bets  (hereinafter referred to as “AKO”) are the bets on  more betting opportunities simultaneously.  The overall odds of AKO are the product of odds of different tips and the partial result is always rounded off to two decimal points. If the on the third decimal point is the digit 5, the result shall be rounded off upward. The claim to winnings only arises subject to that the bettor has correctly guessed the results of all the betting opportunities brought about.

3.2.1Wager “MALÁ DOMŮ” (“A Pass to One´s Own Goalie”)

“MALÁ DOMŮ” is a type of the single bet when the bettor bets on that he/she correctly guesses in another particular AKO bet compiled of N betting opportunities just N – 1 thereof.  “MALÁ DOMŮ” is always printed on the ticket jointly with the associated AKO bet which it relates to in accordance with the foregoing sentence.  It mentions both the odds (i.e.  odds of and odds of “MALÁ DOMŮ”), both the amounts net and both the possible winnings (EVK1, EVK2). The odds of “MALÁ DOMŮ” are fixed by Fortuna in advance and are identical at the instant of the bet for all these bets regardless of the scope and odds of the betting opportunities, in particular, from which the associated AKO bet has been compiled. The amount bet is always at a value of 10% of the amount bet on the associated AKO bet. The winnings are determined in compliance with para. 2.6 of this Gaming Plan as a product of the odds of  “MALÁ DOMŮ” and the amount bet.

Bettor may only lay the bet “MALÁ DOMŮ” always when meeting the parameters of the associated AKO bet specified by Fortuna in advance, which are fixed uniformly for all the bets of this type, similarly as the odds of “MALÁ DOMŮ”, namely:

- achievement of at least the minimum AKO odds;

- not exceeding the maximum odds of different betting opportunities which the associated AKO has been complied of;

- betting at least the specified minimum quantity of the betting opportunities.

If a bettor decides to lay the bet “MALÁ DOMŮ”, he/she must tell the Fortuna attendant still prior to ordering/specifying  the associated AKO bet.

3.2.2 Wager “EXPERT”

Expert is an AKO bet composed of the bets on the betting opportunities determined in advance.  Fortuna specified these betting opportunities in advance and at the same time fixes the time until which the bets “Expert” are accepted (as a rule, the time of the earliest betting opportunity) and determines the bonus value. Bettor has right to claim the winnings upon the correct determination  of all the betting opportunities as in the case of an ordinary AKO bet and moreover the bonus specified for the wager “Expert”.  If there is more than one winning ticket in a single cycle of the bet, the bonus  is split according to the value of the amounts bet on separate winning tickets.   

If certain betting opportunity included in the wager Expert is not implemented and the bets on it are returned, the wager Expert is considered so as if not including this betting opportunity.

If the bets on more than one betting opportunity are returned,  bonus shall not be paid. The bonus value for separate wager Expert cycles is determined by Fortuna in advance.

 3.3 Breakdown bets

Breakdown bets are formed by two or more AKO or SOLO bets. These AKO or SOLO bets arise from the tips selected by the bettor, by means of their compilation in various mathematical combinations (e.g.  »3 of 5 «, »2 of 7«, »FALC«). They involve always a group of  AKO or SOLO bets, which are only technically recorded on a single ticket, especially, because of acceleration. As regards separate  KO pr SOLO on this ticket, all the HP provisions shall apply.

  

4. Acceptance of and Laying the Bets

Acceptance of bets takes place after the publication of the betting odds.  Bets are only accepted by Fortuna employees. The data mentioned on the ticket which must concurrently correspond to the data in Fortuna central database are decisive for the bets laid.

If the bettor identifies a fault in the bet laid or an incorrectly returned amount, he/she must promptly claim this circumstance at the branch office attendant and ask for a remedy. If in doubts consisting in an ambivalent interpretation of the bet laid the bettor may ask for the written description of the subject matter of the bet prior to laying the bet. Complaints relating to the lack of comprehension of the subject matter of the bet or an incorrect identification (identical names, equivocal indication of an abbreviation, etc.) shall not be considered.  Fortuna has the right to suspend acceptance of the bets on any of the betting opportunities or the betting opportunities can be limited in a certain way (e.g. by the value of the sum bet, acceptance for AKO or SOLO bets only, number of the betting opportunities in AKO).

Fortuna can improve the odds by way of percentage increase, resulting in an increase of  EVK. The conditions under which this preferential treatment is granted must be published by Fortuna in advance and it must be indicated in the ticket and recorded in Fortuna database.

The way of laying bets by phone is provided under Article 7 of these  HP.

  

5. Official Result; Return of Bets

 5.1 Official result

a) The result obtained from official sources, announced and published by Fortuna, shall be considered the official and further unchangeable one. . In the event  the official result announced in the above way has been faulty, the bettor´s right to claim the winnings shall not be affected, provided that the bettor has determined the actual result correctly.  .

b) As regards betting opportunities restricted by the specified proper playing time,  the result achieved on the playground after elapsing of the proper playing time shall be considered the official and further unchangeable one,  regardless of any possible extension of the match, penalty  shootouts  and any additional changes of the achieved result (e.g. disqualification, win/loss by default). Elapsing of the proper playing time is considered the end of the match by the referee if the achieved result has been declared final.  Exceptions of this rule are possible, hoqwever, they must be announced by Fortuna in advance. 

c) As regards other betting opportunities (i.e. those where no proper playing time is specified), the result achieved on the playground can be contested in accordance with the applicable rules of separate sports disciplines (e.g. in connection with illegal drug-use).  For the betting purposes, however, only such protest filed with  the controlling body of the competition in question  prior to the publication of the official result by Fortuna and commencement of the payment of winnings shall be taken into consideration; in such case it has suspensive effect.  After a conclusive ruling issued by the controlling body of the competition any additional remedies (such as the protest against protest, change of the court decision, additional disqualification) shall not be considered.

d) If a match (race, competition) without the firmly fixed playing time has not been finished and in spite of that the result is officially announced, then the winnings are paid according to this official result (e.g. ski jumps, tennis, formula-one race, baseball and others).  The condition of  validity of the result achieved in the above way is merely the fact that opponents have started the match.

e) If the match takes place later than within the official time or if the official result has not been announced because of any reason whatsoever, Fortuna waits, as a rule, fo a period of  three following days (unless published otherwise). After this time the bets would be returned. 

f) An exception is the betting on MLB professional League, where each and any match is charecterized by the names of both the teams and the date when the match takes place. If the baseball match has not taken place within the published time because of any reason whatsoever, the bets laid thereon are returned date  and one does not wait for the match to take place on a alternate date. If the same teams play two baseball matches on a single date, the subject of the wager is always the first one of them only. 

 5.2 Claim to the winnings

5.2.1 Non participation and withdrawal of individuals or teams

During the bets on victory or positioning of individuals an teams the lost one shall be considered the bet on the individual or the team, who or which has withdrawn from the competition in the course thereof. If an individual or team has not participated in the competition at all, the bet is returned.

5.2.2 Parallel positioning of individuals or teams

In the event of  a simultaneous victory or positioning of two or more competitors on such place which is decisive for the bet the odds of this tip shall be reduced to one half, namely, with the bets type SOLO and AKO.

5.2.3 Supporting bets

Such SP´s which are mutually supporting each other cannot be included within one AKO bet. They are such SP´s, when the result of a one betting opportunity  affects the probability of the  result of the other SP. Computer “identifies” the supporting bets in all the cases and shall not enable to bring them about.   If such bet has  been still accepted, only the first one of the supporting SP´s  in succession shall be considered in case of a victory and the remaining ones shall be evaluated with the odds equal to 1.0.

 5.3 Return of bets

5.3.1 Bets shall be considered void and null and the amounts bet shall be returned if:

a) the betting opportunity has been erroneously specified due to Fortuna fault.

This does not relates to the odds of an accepted bet;

b) the bet (with an exception of the bet type LIVE – see para. 2.9 above) has been provably laid throughout the betting opportunity in question or after its end; 

c) the match has been entirely cancelled or not finished by an official announcement.

This also refers to bets on better positioning of one of the racers if neither of them has been classified in the competition;  

d) the match with a fixed playing time has not been started at all or has been restarted and finished within the time specified by Fortuna (as a rule, three days), regardless of the circumstance when and with which score the unfinished match has been stopped;

e) the match has been played the other way round, which means that the advantage of home conditions was enjoyed by the team mentioned at the wager top as the guest team. This rule shall not apply to the match played on neutral ground, matches taking place in a competition at the place determined in advance and the cases when the opponent´s playground has been voluntarily selected as the venue of the match in question;

f) the competition rules have been changed or the math has been prematurely finished so that the exactly guessed result could not be achieved; and

g) all the matches in case of bets on the number of goals in a competition or a round have not been implemented.

This procedure shall apply with SOLO bets. AKO bets are only considered null and void  if all the  betting opportunities included therein have been considered null and void.  In the remaining cases  AKO continues to be valid and the null and void betting opportunities are evaluated with the odds 1:1.

5.3.2 Bets shall remain valid if:

a) the controlling committee has cancelled or changed in the course of the competition the initial rules (e.g. in case of a tennis match the payers play for another than the originally specified number of the winning sets or on another surface and in case of a motorist event the race has been cut short, etc.), while applying the provision of  5.3.1 letter f) above;

b) the match has taken place earlier than within the originally announced time, while applying the provision of 5.3.1 letter b) above;

c) the match has been stopped but is finished or replayed within a time specified by Fortuna (as a rule, three days);

d) the match has been postponed but is played within a time specified by Fortuna (as a rule, three days);

e) more competitions take place in the same discipline, on the same place and in a short time succession, e.g. downhill races of the World Championship or ski jumps on a bridge with the same critical point, the subject matter of the bet is always the first race taking place; and.

f) the venue of matches the bets has changed,  the table positioning,  further advancement to other rounds of the competition and another bet of a longer-term nature continue to be valid; and

g) a minor mistake in the racer´s (team, competition) name has taken place, unless affecting the material substance of the bet.

  

6. Bet Amounts  and Winnings

 6.1 Bet amount

Minimum bet amount per ticket is CZK 5. In case of the breakdown bets (pursuant section 3.3 above) the minimum bet amount per partial bet is CZK 0.01. Fortuna may  specify for individual types of bets the minimum amount to be bet higher than the usual one and shall publish the corresponding information thereon.

Maximum bet amount is restricted by the limit of winnings per ticket.

 6.2 Limits of winnings 

Maximum winnings per ticket are limited as follows:

a) limit of the maximum winnings per ticket is specified at a value of CZK 5,000,000 for all types o bets, including numerical games, with an exception of the numerical game „5 of 50“, where this limit has been specified at a value of CZK 10,000,000; 

b) limit of the maximum net winnings (i.e. the winnings after deduction of the bet amount) per SOLO or AKO bet is specified as follows:

- CZK 150,000 for SOLO and AKO comprising 1 to 6 betting opportunities;

- CZK 300,000 for  AKO comprising 7-14 betting opportunities;

- CZK 600,000 for AKO comprising 15-19 betting opportunities;

- CZK 1,000,000 for AKO comprising 20-29 betting opportunities;

- CZK 2, 000,000 for  AKO comprising 30 and more betting opportunities;

- CZK 2, 000,000 for numerical games, except the numerical game „5 of 50“; and

- CZK 10, 000,000 for numerical game „5 of 50“.

In case of breakdown bets the limits of individual AKO´s and SOLO´s are added.  Fortuna is entitled to increase and reduce the limits for separate bets but must notify the bettors thereof in a convenient way.

 6.3 Payment of winnings

Payment of winnings shall begin immediately after the publication of the official result by Fortuna. The period of collection of the winnings at the branch office is thirty (30) days after the beginning of the payments.  The claim to winnings may be however asserted at the company head-office in writing within the following thirty (30) days. Fortuna is obliged to pay the winnings within this period of time. After elapsing of the above time the claim to winnings in terminated.  In justified cases (in case of higher winnings) the payment may be postponed by the time required to transfer the cash to the branch office.

Payment of winnings will be made based on the valid ticket at any of the branch offices, and/or the company head-office. The ticket must not be disturbed and no additional changes of the ticket may be made.  As the data in Fortuna computer are decisive on an exclusive basis for the purpose of claiming the winnings, the presented ticket only justifies to search for and identify these data in the computer. .It is thus in the interest of each and any bettor to protect his/her ticket against misuse by a third party, because each bet may be paid only once. 

In the event of payment in cash exceeding a value of CZK 30,000 the bettor is obliged to agree because of safety reasons with the branch office manager the exact time of payment, minimum one day in advance. If the branch office has the required amount at its disposal, it can pay it immediately. If the winnings exceed a value of CZK 100,000 (and even lower if mutually agreed), Fortuna is entitled to send the amount to the bettor according to the bettor´s written  instruction to a bank account or to pay it in cash at the company head-office. In the event of cashless payment (payment by bank transfer) the delivered winning tickets are replaced by a confirmation issued by the branch office attendant. When asserting a claim to payment of any winnings, the bettor is obliged to present his/her ID card if asked to do so. In the opposite case Fortuna is entitled to suspend payment of the winnings until the time when this condition has been complied with.  In the case of an established  Account (in accordance with the definition referred to under section 8.3) . Fortuna pay the winnings to the bettor´s Account within one (1) working day after publication of the official result by Fortuna. .

Fortuna is entitled to specify a limit for the maximum cash payment even at a lower value than that of CZK 100,000 at  selected branch offices.

  

7. SPECIFIC WAYS TO LAY BETS TELEKONTO (“TELE ACCOUNT”)

 7.1. TELEKONTO is a specific type of laying bets by means of phone.

 7.2. As regards TELEKONTO, all the provisions of HP shall apply accordingly. 

 7.3. Person interested in this way of betting can utilize TELEKONTO services only after entering into the written contract concluded by and between Fortuna and the bettor in person at any Fortuna branch office, after opening an account with Fortuna (the “Account”) and after making the initial deposit to the Account for this type of betting at the minimum value referred to in the contract.

Upon signature of the contract the bettor is obliged to present the ID card from which Fortuna verifies accuracy of his/her personal data, especially, the condition  of reaching 18 years of age.

 7.4. In the case of TELEKONTO service the electronic record of laying the bet, saved in Fortuna database, shall be considered the ticket. Fortuna will provide a telephone recording of the acceptance of bets laid by phone.  For the purpose of safety and  identification of bettors each bettor will be allocated on identification No. and one protective password, to be referred to by the bettor with any bet laid by phone. Bettor may moreover select because of a higher safety  an option that his/her bets van be laid only from the telephone number specified in advance. Bettor is obliged to handle his/her access passwords so that to prevent their disclosure to unauthorized persons. 

 7.5. Deposits to and collections from the bettor´s Account may be made only in cash at any Fortuna branch office or by bank transfer, and/or by means of a credit card.

Funds kept on the Account are not paid any interest on.  In the event of termination of the contract these funds will be returned to the bettor.

  

8. CLOSING PROVISIONS

 8.1 Nonacceptance of the bet

Fortuna has the right  not to accept the bet from a person violating HP or the Visiting Rules. If the acceptance of bets has been suspended in consequence of extraordinary circumstances, the bettor is not entitled to claim payment of any damages or to enforce any other rights, unless expressly provided so by HP.   

 8.2 Confidentiality

Fortuna is obliged to maintain all the information and data regarding bettors confidential with an exception of the proceedings conducted by the Police Department of the Czech Republic, investigative, prosecuting and adjudicating bodies, as well as cases when the bettor has agreed in writing with the disclosure of his/her data.

 8.3 Complaints; modifications of and amendments to HP

Bettors may file justified complaints with Fortuna which will investigate them and will notify the complainant of the result within a period of thirty (30) calendar days. In the cases not provided by HP the bettor must submit to Fortuna decisions.

Fortuna reserves the right to modify or amend this HP in collaboration with the Ministry of Finance of the Czech Republic. These modifications and amendments, as well as a possible interpretation of individual provisions of HP, will be published by Fortuna. .

This Gaming Plan has been published based on the Licence ref. 34/80712/2008 of 19 November 2008, granted by the Ministry of Finance of the Czech Republic. At the same time, the Gaming Plan ref.  34/59749/2008 of 19 August 2008 approved by the Ministry of Finance of the Czech Republic has been terminated hereby.
