GENERAL TERMS AND CONDITIONS OF THE LOYALTY PROGRAM FORTUNA CLUB PLUS AND THE I-KONTO SERVICE


1.         FORTUNA CLUB PLUS

1.1      FORTUNA CLUB PLUS (“Club”) is a loyalty program that is offered by FORTUNA GAME, a. s., registered office Vodičkova 699/30, 110 00 Prague 1 - Nové Město, Czech Republic, reg. no.: 430 03 575 (“Fortuna”), to its clients at all Fortuna branches in the Czech Republic or via the service called I-Konto. For an up‑to‑date list of all Fortuna branches and/or affiliates, please go to www.ifortuna.cz (“Branches”). The Club focuses on providing above‑the‑standard benefits to correctly registered clients using Fortuna’s services.

1.2      Fortuna’s affiliates and natural and legal persons who are Fortuna’s partners in connection with operating the Club are involved in the operation and organization of the loyalty program FORTUNA CLUB PLUS (“Partners”).

1.3      These General Terms and Conditions (“Terms”) provide the rights and obligations of Fortuna’s clients who have met all requirements for the admission of a client of Fortuna to the Club.

1.4      Following correct registration, a client of Fortuna will be able to obtain an entrance bonus (and an extraordinary bonus, if appropriate) on the conditions set forth herein and enjoy a number of benefits for the points he or she obtains. A registered client will also be able to take part in special competitions to win valuable prizes which are exclusively designed for registered clients.

2.         CLUB MEMBERS AND CONCLUSION OF CONTRACT

2.1      Any natural person who is entitled to place bets according to Czech Act No. 202/1990 Coll. on lotteries and similar games, as amended, and who agrees to the Terms and the Online Fixed‑Odds Betting Plan (“Betting Plan”) and whose application for Club membership (“Application”) has been accepted by Fortuna may become a Club Member (“Club Member”). No legal person may become a Club Member. No legal claims for admission to the Club may be made. Every natural person may only have one Club membership, which cannot be assigned to third parties.

2.2      A contract for online fixed‑odds betting (“Contract”) is concluded between the parties when a client of Fortuna unconditionally signs an Application and Fortuna accepts the Application, and the parties’ rights and obligations will be governed by these Terms and the Betting Plan.

2.3      Application forms are available from the Branches and www.ifortuna.cz. Fortuna will only accept an Application if all obligatory details have been entered in the Application as required. By completing and signing the Application, the client confirms that he or she agrees to these Terms as well as the Betting Plan.

2.4      Every client of Fortuna who meets the conditions set forth in 2.1 will become a Club Member upon properly completing an Application and accepting a Club Card issued by Fortuna immediately after the acceptance of the Application (“Club Card”). Every Club Member may only have one active Club Card.

3.         CLUB CARD

3.1      A Club Card helps to identify a Club Member when he or she is making bets at Branches, obtain and use points registered in the Club Member’s Points Account, register and determine the points balance in the Club Member’s Points Account and use any other benefits arising from being a Club Member. A Club Card also serves as an electronic purse that allows cashless payments and cash collection at Branches via the I-Konto on the conditions specified in these Terms and/or the Betting Plan. The Club Card cannot be transferred to a third party and is the property of Fortuna.

3.2      In order to be able to use the benefits arising from Club membership, it is important that a Club Member submits his or her Club Card to a Branch assistant before a transaction. Failure to submit the Club Card to the Branch assistant implies that the Club Member does not wish the transaction to be included in the Club.

3.3      Branch assistants may seize a Club Card if it is submitted by a person other than the Club Member. Fortuna may at any time check the identity of the person submitting a Club Card against his or her identity document.

3.4      Every Club Member must protect his or her Club Card from loss, theft and destruction. In the event of loss, theft or destruction of his or her Club Card, the Club Member must immediately inform a Branch. A duplicate Club Card will normally be issued to the Club Member within three weeks of a written request by the Club Member delivered to any Branch. Fortuna may charge a fee for issuing a duplicate Club Card.

3.5      Fortuna may at any time block a Club Card if Fortuna reasonably suspects unauthorized use of the Club Card. The Club Card will be unblocked after the suspicion has been dealt with.

4.         HOME Branch

4.1      The Home Branch is a Branch where his or her Club Card was issued to the Club Member (“Home Branch”). The Club Member will take part in branch or nationwide competitions held by Fortuna via his or her Home Branch. Every Club Member is automatically included in his or her Home Branch Club competitions, provided that the competition rules take the Home Branch into account.

4.2      Branch and nationwide competitions will reflect all bets placed at Branches or, on the conditions set forth in the Betting Plan, bets placed via a software application located at www.ifortuna.cz (“Software Application”) and bets placed by telephone. All competitions will only be assessed at the Club Member’s respective Home Branch.

5.         POINTS ACCOUNT, POINTS, AND AWARD OF POINTS

5.1      The Points Account is an account of the Club Member that registers all the points he or she has won (“Points Account”). The current balance of the Points Account is printed out on a receipt (provided that a valid Club Card was submitted before the transaction). Typically, the up‑to‑date balance of the Points Account can also be obtained against the Club Card at any Branch, on www.ifortuna.czafter logging into the Software Application, or by calling Fortuna’s customer service.

5.2      Points are units received by the Club Member for bets placed (Fortuna may exclude some bets). The Club Member will receive points depending on the amount of his or her bet, so that the Club Member receives one point for every CZK 5 betted (net of a processing fee charged by Fortuna), provided the bet has been placed at a Branch. If the bet has been placed in a different manner, the Club Member will receive a point for every CZK 10 betted (net of the processing fee charged by Fortuna).

5.3      No points are awarded for PROFISÁZKY or LIVE bets. The Club Member’s Points Account may only be credited with 1000 points a day for bets placed by the Club Member.

6.         HOW TO USE POINTS AND BENEFITS

6.1      Every Club Member may purchase improved odds for the points he or she has received if he or she meets the following criteria:

Bonus 5 involves odds improved at a rate of 1.1 after the fifth bet. Bonus 5 improved odds can be purchased for one day for 500 points.

Bonus 8 involves odds improved at a rate of 1.1 after the eighth bet. Bonus 8 improved odds can be purchased for one day for 150 points.

Plus 10 involves odds improved at a rate of 1.1 after the tenth bet. Plus 10 improved odds can be purchased for one ticket for 20 points.

Plus 15 involves odds improved at a rate of 1.15 after the fifteenth bet. Plus 15 improved odds can be purchased for one ticket for 20 points.

Plus 20 involves odds improved at a rate of 1.2 after the twentieth bet. Plus 20 improved odds can be purchased for one ticket for 20 points.

6.2      Plus improved odds cannot be combined with each other or with Bonus 5 or Bonus 8. Favorit Dne and Terno Dne bets cannot be included in the number of bets above.

6.3      The limit of the daily use of Bonus 5 and Bonus 8 improved odds is CZK 5,000 and no subsequent bets are based on improved odds. Improved odds can only be purchased for “AKO” (accumulator) bets composed of bets each of which has (i) odds of at least 1.5:1 in the case of Bonus 5 and Bonus 8 and (ii)  odds of at least 1.1:1 in the case of Plus 10, Plus 15 and Plus 20 each.

6.4      In addition to purchasing improved odds, points can be used to purchase products specified by Fortuna. They include odds lists, betting plans, informative text messages with ticket or match results, and promotional materials that are being offered at the moment.

6.5      All points obtained during a calendar year may be used by the Club Member to purchase services or products specified by Fortuna pursuant to these Terms by the last day of the calendar year in which the Club Member has won the points. Fortuna will invariably set the Points Account to zero on the first day of the following year.

7.         ENTRANCE bonus AND SPECIAL bonus

7.1      A client of Fortuna whose Application has been accepted by Fortuna may obtain an Entrance Bonus in the amount and on the conditions specified in these Terms on registration (“Entrance Bonus”). In order to obtain the Entrance Bonus, the client has to tick the Entrance Bonus Award box in his or her Application and confirm that he or she has read all the requirements for the award of the Entrance Bonus which are described in more detail in these Terms. The Entrance Bonus is only for new registered clients of Fortuna.

7.2      An Entrance Bonus of CZK 200 will be awarded to a Club Member if he or she has placed a bet(s) with Fortuna totaling at least CZK 200. If the Club Member does not achieve the total amount specified in this section with a single bet, the total amount must be achieved within one month of the first bet placed by the client as a Club Member to get the Entrance Bonus. PROFISÁZKY and LIVE bets are not included in calculating the amount required in this section. The Entrance Bonus will be credited to the I-Konto within 24 hours after meeting the requirements for the Entrance Bonus to be awarded. Every new registered client can only obtain the Entrance Bonus once.

7.3      A client who wishes to become a Club Member may obtain a Special Bonus instead of a Bonus at times specified by Fortuna in advance (“Special Bonus”). In order to obtain the Special Bonus, the client has to tick the Special Bonus Award box in his or her Application and confirm that he or she has read all the requirements for the award of the Special Bonus which are described in more detail in these Terms. The Special Bonus may also be obtained by selected Club Members, who will be informed by Fortuna about this opportunity in advance, on the same conditions as the clients who wish to become new Club Members.

7.4      The Special Bonus for a newly registered Club Member is 100% of his or her initial I-Konto deposit and, in the case of an existing Club Member, 100% of his or her new I-Konto deposit, subject to his or her consent to the requirements for the award of the Special Bonus (“Initial Deposit”), and amounts to a maximum of CZK 2,000. In order that the Special Bonus can be awarded, the Initial Deposit that is used to calculate the Special Bonus must be deposited by the Club Member  in his or her I-Konto within seven calendar days after the date of his or her Club registration or after the selected Club Member has consented to the requirements of the Special Bonus. If the Initial Deposit in the I‑Konto exceeds CZK 2,000, the amount of the Initial Deposit of CZK 2,000 will apply to the calculation of the Special Bonus. The Special Bonus will be credited to the I-Konto within 24 hours after the Initial Deposit has been deposited in the I-Konto. The Special Bonus awarded by Fortuna may only be used to place a bet. Every new registered client or selected Club Member can only obtain the Special Bonus once.

7.5      After the Special Bonus has been credited, all I‑Konto payouts to the Club Member are blocked until the requirements for unblocking the I‑Konto have been met. The Club Member’s I-Konto will be unblocked, that is to say, the Club Member will be allowed to collect or transfer money deposited in his or her I-Konto after the Club Member who has obtained a Special Bonus has complied with the requirements specified in 7.6. The rules defined in these Terms and/or the Betting Plan apply to the collection and transfer of money from and to the I‑Konto.

7.6      In order to have his or her money released from the I-Konto pursuant to 7.5, the Club Member must have placed bets with Fortuna which amount to four times his or her Initial Deposit together with the Special Bonus he or she has obtained. However, bets with minimum total odds of 3:1 will only be included in the calculation of the amount required in this section.

7.7      The required amount will also include all bets which comply with the requirements set forth in 7.6 and which have been placed by the Club Member at a Branch, provided that the Club Member submitted his or her Club Card to the Branch assistant before placing a bet. In order to pay for a bet at a Branch, one can use money deposited in one’s I‑Konto which will be debited from the I-Konto after a valid Club Card was submitted to the Branch assistant. Profits on bets which were paid for using money deposited in an I-Konto will not be paid out to the Club Member in cash but will be automatically credited to the Club Member’s I‑Konto immediately after his or her bets have been evaluated until the requirements for unblocking the I-Konto pursuant to 7.5 have been met. This information will be appropriately mentioned in a bet receipt.

8.         I-Konto

8.1      Upon a client’s registration on the conditions specified in these Terms, Fortuna will activate the Club Member’s I‑Konto, which allows the Club Member to (i) place bets online on the conditions specified in the Betting Plan and (ii) place cashless bets at Branches and (iii) place bets via telephone.

8.2      In connection with activating his or her I-Konto service, Fortuna will create an I‑Konto account for the Club Member within five working days after he or she became a Club Member (“I-Konto”) and this account will be assigned a number quoted in the Application. The I-Konto is described in more detail in the Betting Plan, which refers to the I‑Konto as “Konto.” The Betting Plan also includes information about the I-Konto, how to obtain I‑Konto access details and the Club Member’s obligations related to the protection of access details.

8.3      The Club Member may use the money in his or her I-Konto in the manner and on the conditions specified by the Terms and/or the Betting Plan. In the event of any discrepancies between these Terms and the Betting Plan, these Terms will always prevail.

9.         COLLECTION OF PERSONAL INFORMATION

9.1      By signing his or her Application, the Club Member agrees that Fortuna may, according to Act No. 101/2000 Coll. on the protection of personal information, as amended (“Personal Information Act”), process personal information provided by the client to Fortuna in connection with his or her membership of the Club. Fortuna or a data administrator selected by Fortuna (“Administrator”) will process the information for the purposes specified in these Terms. Fortuna will especially process the personal information to operate the Club as a whole, create a database of Club Members for the purpose of using Club benefits, process company statistics, ensure the security and integrity of the Club, further process the personal information on a marketing basis (including service and product offerings) and send commercial messages via electronic means according to valid laws.

9.2      The Club Member also agrees that part of the personal information submitted by him or her (name, surname, address, e-mail and telephone) may be provided to Fortuna’s Partners and/or Administrators to check whether or not one is authorized to enjoy the benefits offered by the Club and/or to process the information to send commercial messages containing news and information about Fortuna’s products and services via an SMS/MMS or e‑mail.

9.3      The Club Member agrees that if the Club Member gets into an area where he or she can receive a commercial message, the mobile operator will localize him or her for the purposes of sending a commercial message and provide the Administrator with the data.

9.4      The Club Member is aware that he or she has the right to access his or her personal information and other rights according to §§11 and 21 of the Personal Information Act. The Club Member is aware that he or she voluntarily consents to his or her personal information being processed and that the Club Member can at any time withdraw his or her consent, which will result in the termination of his or her Club membership.

9.5      Fortuna declares that it fully guarantees the security of the personal information provided and is responsible for the personal information provided not being abused by an unauthorized person. Fortuna also declares that it considers the personal information provided to be confidential and may not disclose it, save as provided by these Terms and laws.

9.6      Fortuna reserves the right to publish the names of the winners of competitions and marketing events held by the Club (including preliminary rankings), unless the Club Member has requested the opposite.

10.      DURATION

10.1   The Contract will be for an indefinite period of time. Fortuna and the Club Member may cancel the Contract without cause by giving a one‑day written notice, and the one‑day period will commence on the day that follows receipt of the notice by the other Party.

10.2   The Club Member’s I-Konto balance will be transferred to the Club Member’s bank account specified by the Club Member in his or her Application or a bank account provably notified by the Club Member to Fortuna during the term of the Contract, the transfer to be effected within 10 days after the expiration of the Contract. The Parties must settle their mutual liabilities and claims based on the Contract before the Contract expires and before the I‑Konto is terminated.

11.      FINAL PROVISIONS

11.1   Fortuna reserves the right to amend these Terms at any time and all such changes will be binding on the Club Member as of the date they become effective. The changes will become effective on a date specified by Fortuna and Fortuna must publish the changes as appropriate (at Branches or on www.ifortuna.cz) not less than five days before the changes to the Terms become effective. In cases not described herein, Fortuna’s decision will be binding.

11.2   Fortuna may terminate the membership of the Club Member if the Club Member has breached the Terms, the Betting Plan or any other generally binding law connected with placing bets with Fortuna. Fortuna may also terminate the membership of the Club Member if the Club Member is found to have entered false information in his or her Application.

11.3   Fortuna reserves the right to terminate the Club at any time and the termination of the Club must be notified to the Club Members in an appropriate manner at least one month in advance.

11.4   This version of the Terms comes into force and becomes effective on 01 December 2011.
